U.S. Dept. of Labor FAQ about Qualified Domestic Relations Orders
A qualified domestic relations order is a specific legal order that is used following a legal separation or a divorce in order to split or change the ownership of a retirement plan or pension.
The ownership of retirement plans or pensions can be transferred to:
- a spouse
- a former spouse
- a child of the current owner of the plan
- other dependent
Additionally, qualified domestic relations orders can only be applied to benefit or pension plans under ERISA.
Regardless of which side of the domestic relations order you are on – whether you are the owner of the retirement plan or pension, or whether you are the potential recipient of the plan or pension – this is a highly sensitive issue that requires the knowledge and skills of a seasoned family law attorney.
